Release of Liability and Product Use Acknowledgment

This Release of Liability and Product Use Acknowledgment applies to automotive products purchased from or used in connection with ExoTuning, operated by Mercury Ecom LLC.

By purchasing or using our automotive products, you acknowledge the following:

1. Understanding of Automotive Risks

Automotive performance parts, exhaust systems, ECU tuners, and related accessories may affect the operation and performance of a motor vehicle.

Depending on the product and its application, installation or use may involve risks including:

• Mechanical failure.

• Electrical or electronic malfunctions.

• Engine or drivetrain damage.

• Exhaust leaks or excessive noise.

• Reduced component lifespan.

• Changes in vehicle performance or drivability.

• Personal injury or property damage resulting from improper installation or use.

2. Customer Responsibility

You acknowledge that you are responsible for:

• Selecting products appropriate for your vehicle.

• Confirming product compatibility.

• Following manufacturer installation instructions.

• Using qualified installation professionals where appropriate.

• Maintaining your vehicle in safe operating condition.

• Complying with applicable federal, state, and local laws.

3. Professional Installation

We strongly recommend installation by a qualified automotive technician.

You acknowledge that improper installation, incorrect configuration, unauthorized modifications, or failure to follow instructions may cause damage to your vehicle or other property.

4. Legal and Regulatory Compliance

You are responsible for ensuring that the purchase, installation, and use of any product comply with applicable vehicle safety, emissions, noise, and environmental regulations.

Products must not be used to unlawfully defeat, bypass, disable, or remove emissions control systems.

Any competition-only or off-road product must be used only in applications legally permitted for that product.

5. Warranty and Product Defects

This acknowledgment does not waive your rights concerning defective products, applicable manufacturer warranties, statutory warranties, or any other consumer protections that cannot legally be waived.

Please contact our customer support team if you experience a product defect or safety concern.

6. Limitation of Release

To the extent permitted by applicable law, Mercury Ecom LLC and ExoTuning are not responsible for losses resulting from improper installation, misuse, unauthorized modifications, or use contrary to applicable laws and manufacturer instructions.

Nothing in this document releases ExoTuning from liability for its own negligence, willful misconduct, product defects, or other liability that cannot legally be waived.
